Bylaw 339
A Bylaw of the Town of Lacombe to provide for
the imposition of off-site levies for lands proposed
for subdivision or development
WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000, c M-26, Council deems it expedient to impose upon lands that are to be developed or subdivided off-site levies for the purposes of paying for all or part of new or expanded water, sanitary waste water, storm sewer and drainage facilities as well as for collector roads
WHEREAS notice of Council's intention to consider passage of this bylaw at the March 27, 2006 regular meeting was given pursuant to Section 606 of the Municipal Government Act
NOW THEREFORE the Municipal Council of the Town of Lacombe, in the Province of Alberta in Council assembled, enacts as follows:
There shall be imposed on lands to be developed or subdivided an offsite levy or combination of offsite levies as may apply to the lands to be developed or subdivided for the costs of constructing certain improvements at the rates set out following and detailed in Schedules A through G.

The offsite rates for each
improvement shall be calculated by dividing the estimated or
actual net
present cost of the improvement by the number of acres of developable land
that is expected to benefit from the construction of the improvement.
The offsite levies to be
imposed with respect to individual developments or subdivisions
shall be the
sum of each of the rates for the improvements set out in Section 1 from
which the lands will benefit multiplied by the developable area of the lands
in acres
The owner of lands to be
developed or subdivided shall, as a condition of development
or subdivision
approval, enter into an agreement to pay to the Town the offsite levies
authorized to be imposed under this bylaw.
Schedules A through G are attached hereto and shall form a part of the By-law.
Town of Lacombe By-laws
207, 219 and 283 and amendments thereto, are hereby
repealed.
This By-law shall come into force and effect upon final reading thereof.
