AGREEMENT made in duplicate this 30th day
of November A.D., 1987
BETWEEN:
THE TOWN OF
LACOMBE
(hereinafter
called the "Town")
OF THE FIRST
PART
-
and –
THE LACOMBE
AND DISTRICT MUSIC FESTIVAL ASSOCIATION
(hereinafter
called the "Association")
OF THE SECOND
PART
WHEREAS the Town is the owner of the Lacombe Memorial
Center located in Block 34, Plan 1979 HW, and the Town is in agreement to
provide a portion of the facility for the location of a Grand Piano owned
by the Association,
NOW THEREFORE, in consideration of this agreement it
is understood and agreed between the two parties hereto, their successors
or assigns as follows:
Stage Upgrading
That the Association and the Town will renovate the
east side of the stage in the LMC auditorium as outlined in Schedule
“A”. This renovation will
include
i)
changes to the east stairs allowing continued access to the stage
ii)
changes to the east backstage door allowing continued access
backstage from the new addition. The
cost of the renovations and the design decisions shall be shared equally
between the Town and the Association, with the Town’s contribution being
in kind or in cash to a maximum of $1500.00.
Piano Use
The piano will be used for the following activities:
Lacombe and District Music Festival; Rotary Carol Festival;
November Arts Week Dinner Theatre, for example and other events as approved
by the Association. The piano
will not be available for practice use.
Regularly scheduled tuning, and annual maintenance to the piano
action shall be the responsibility of the Association. The cost for additional tuning shall be borne by the group
requesting the service, and shall be arranged by the Association.
Cost of repairs resulting from use by a particular group shall be
borne by the group with repairs being arranged by the Association.
Piano Rental
The town shall pay an annual rental fee to the
Association for use of the piano by functions other than the Music
Festival. This rental fee
shall be equal to the rent charged to the Association for the use of the
LMC for the piano competitions during the Festive (the final Grand Concert
being excluded).
Fees
No fees will apply for the storage of the piano at
the LMC. Normal rental rates
will apply to the various functions at which the piano is being used.
Insurance
As the piano is to be located in a Town owned
facility, it shall be covered against damage or theft under the Town’s
policy.
Termination
This agreement may be terminated by either party
provided sixty (60) days written notice is provided.
IN WITNESS WHEREOF the parties hereto have caused
these present to be executed, the day and year first above written.
