AGREEMENT FOR JOINT USE OF FACILITIES
This agreement made this 30th day of September, 1996
BETWEEN:
Town of Lacombe, a municipal corporation in the Province of Alberta (hereinafter called the "Town")
OF THE FIRST PART
AND
Wolf Creek Regional Division No. 32, a school authority in the Province of Alberta (hereinafter called the “Division”)
OF THE SECOND PART
WHEREAS, the Town and the Division encourage and support the use of community facilities to the maximum benefit of the residents, and
WHEREAS, the sharing of facilities should result in the most economic provision of public education, recreation and cultural programs, and
WHEREAS, the Division has facilities with in the following schools
I)J. S. McCormick Elementary School,
ii)Nelson School,
iii)Lacombe Upper Elementary School,
iv)Lacombe Junior High School, and
v)Lacombe Composite High School.
(Hereinafter referred to collectively as “the Schools”)
that are not fully utilized during non-school hours. and
WHEREAS, the Town has facilities that are not fully utilized during school hours.
NOW THEREFORE THE PARTIES AGREE AS FOLLOWS:
GENERAL PROVISIONS
1.The Town will make available to the Schools for school use, Town operated facilities such as the Lacombe Sports and Leisure Complex, the Lacombe Memorial Centre, parks and playing fields at no charge, subject to such exceptions as may be set out in this Agreement, if such facilities are not in use for regular community programs or revenue producing functions.
2.The Division will make available facilities within the Schools for recreation and culture activities which have been authorized by the Town at no charge, subject to such exceptions as may be set out in this Agreement, for times not designated for school programs or not designated for other activities authorized by the Division.
3.Activities sponsored under this agreement are not for profit making purposes.
4.The Principals, in the case of the respective school facilities, or the Chief Administrative Officer, in the case of the Town, may at their discretion decline to allow any group or organization the use of the facilities under this agreement if such groups or organizations have exhibited unsatisfactory behaviour during prior use of the facilities.
FACILITIES TO BE USED
5.Under this agreement:
a) “School Facilities” shall include:
I) Gymnasia in the Schools
ii)Classrooms in the Schools
iii)Auditorium in the Lacombe Composite High School.
iv)Playing Fields
b)“Town Facilities” shall include:
I) Lacombe Sports and Leisure Complex including the Kinsmen Aquatic Center, Barnett Arenas 1 and 2, meeting rooms and the use within the facility of related equipment and furniture.
ii) Lacombe Memorial Center including the main auditorium, banquet room and kitchen facilities. Tables and chairs from the Center may be used by the Lacombe Composite High School for Graduation Ceremonies at a remote location.
iii)Michener Recreation Area including ball diamonds, playing fields and track facilities.
iv)Kinsmen Ball Park
v)Tennis courts, ball diamonds and soccer fields located on the School’s grounds.
vi)Other parks and playgrounds and such other facilities as may become available.
5.1Other facilities within the school which house special equipment or materials or are used for special purposes such as libraries, vocation and industrial arts centres, computer rooms, science laboratories are not included under this agreement, but may be available for non-school, public use upon arrangement with the respective school’s Principal.
WHO MAY USE FACILITIES
6.The following may use the School and Town Facilities at no charge under this agreement:
a)Local youth groups and minor sports organizations sponsored by the Recreation, Parks and Culture Services operated by the Town (hereinafter referred to as Recreation Services). Sponsored activities shall be defined as activities directly organized by Recreation Services or recreation oriented activities organized by local community organizations.
b) Students attending the Schools who are under the supervision of a staff member or volunteer approved by the Principals of the Schools or by the Division.
7.Local adult cultural and recreational organizations sponsored by Recreation Services may use the School Facilities under this agreement; however, the Division reserves the right to charge a fee for the use of School Facilities by these organizations. Where fees for use are to be levied, the Division will provide adequate notice to Recreation Services so that program fees can be adjusted accordingly.
TIME TO BE USED
8.School Facilities, with the exception of the three classrooms located on the second level of the 1981 Nelson School Gymnasium Addition, may be used when they are not required for school activities, activities authorized by the Division or when they are not being cleaned or refurbished.
9.The three classrooms located on the second level of the 1981 Nelson School Gymnasium Addition may be used when they are not required for school activities, activities authorized bythe Division, Scout or Guide activities, or when they are not being cleaned or refurbished.
10.Town facilities may be used when they are not required for recreational programs, revenue producing functions or when they are not being cleaned or refurbished
BOOKING AND USE OF SCHOOL FACILITIES
11.On an ongoing and timely basis, the Principals shall provide Recreation Services with a schedule of the availability of school facilities and Recreation Services will provide to the Principals a schedule of known uses proposed for School Facilities.
12.A request for the use of School Facilities under this agreement must be made through Recreation Services.
13.Local Community Organizations wishing to use School Facilities under this agreement are required to complete a booking request form and agreement at the Recreation Services office
14.Where the activity is to be sponsored by Recreation Services, a representative of Recreation Services will endorse this booking by signing the booking request form and agreement.
15.The Local Community Organization will forward the booking request form and agreement to the Principal of the respective school for consideration and approval not less than two (2) weeks prior to the time the facility is needed.
16.The Principal's decision on the request will be made within one week of the Principal’s receipt of the application and, if approved, the Principal will sign the booking agreement.
17.Bookings for the Easter and Christmas holidays and for July and August must be made two (2) weeks prior to the beginning of the holiday period.
18.The group using a school facility shall designate a responsible member who shall sign the application form and will be present during the activity. This person shall ensure that the facility is vacated in the same condition as it was entered.
19.Activities which are not sponsored by Recreation Services will be referred directly to the Principal of the respective school.
(h)The Town acknowledges that, during the summer holidays or school breaks, certain school facilities or parts of school facilities may not be available for joint use activities due to maintenance activities or the inability to arrange school staff to allow access to the facility. In such cases the Principal may, at the Principal’s discretion, decline to allow the use of the facility under this agreement.
BOOKING AND USE OF TOWN FACILITIES
General Provisions
20.On an ongoing and timely basis, Recreation Services shall provide the Principals with a schedule of the availability of Town Facilities and the Principals shall provide to Recreation Services a schedule of known uses proposed for Town Facilities.
21.Town employees shall be in attendance while Town Facilities are used by the Schools.
22.Town Facilities used by school groups shall also be left in the same condition as when they entered the facility.
23.Notwithstanding the time frames for the submission of booking requests for the Town’s facilities set out following, the Town will endeavour to accommodate booking requests wheneverreceived.
Lacombe Sports and Leisure Complex - Kinsmen Aquatic Center
24.Recreation Services will forward booking request forms to each Principal at least one month prior to the opening of the Aquatic Center in each year. Recreation Services will identify the programming time blocks for the aquatic season and the dates by which booking requests from the Schools must be received.
25.A master schedule for all school use shall be prepared by Recreation Services no later than two (2) weeks prior to the beginning of each programming time block and forwarded to the Principals.
26.The Town will provide, at no cost, a senior staff member to supervise the aquatic facility during use by the Schools.
27.In addition to the senior staff member, the Town will supply additional qualified instructors or lifeguards as may be required by the Town in accordance with provincial regulations to teach the lessons or supervise the free swimming planned by the Schools.
28.For each additional lifeguard required beyond the senior staff member, the Division will pay to the Town $9.30 per hour in 1996 with the hourly rate to be adjusted on a yearly basis in accordance with the wage increases adopted by the Council of the Town.
29.Where the use of equipment has been authorized by the Schools, the Schools shall compensate the Town for any damage incurred beyond normal wear and reasonable use of the equipment.
Lacombe Sports and Leisure Complex - Barnett Arenas
30.Recreation Services will forward booking request forms and a schedule of available times for the arenas to the Principals at least two (2) weeks prior to the start of the school year.
31.The Principals shall submit these booking request to Recreation Services prior to the end of September. All requested ice time for the Schools during the winter operation period of the arena, typically from October through March of the following year, is to be identified.
32.Prior to the opening of either of the arenas, Recreation Services will forward a master list of school usage for the winter season to the Principals.
All Other Facilities
33.Booking requests for the use of any of the other Town Facilities shall be forwarded toRecreation Services not less than two (2) weeks prior to the time the facility is needed. A decision by Recreation Services shall be made within one (1) week of receipt of the application.
LIABILITY INSURANCE
34.The Division and the Town shall maintain adequate liability insurance coverage for school activities and recreation services sponsored activities respectively.
AMENDMENTS
35.The terms of this agreement may be altered by written consent of the parties. Proposed amendments submitted by either party to the other must be addressed within thirty (30) days of submission.
TERMINATION
36.This agreement may be terminated by either party upon two (2) months written notice to the other of intent to withdraw from the agreement.
